Indonesia - Work Injury

 

According to the Government Regulation No. 14/1993 on Workers’ Social Security Programmes, participation in Jamsostek’s occupational injury, old age, and death benefits programmes is compulsory for all formal private sector employees.

 

Employment injury

* Jamsostek occupational injury (JKK) | data

Target: compulsory for all formal private sector employees.
Benefits: employment injury insurance covers accidents at work, occupational disease arising out of employment, and travel accidents that occur while traveling to and from work following the usual rout. The contribution is fully paid by employers and ranges from 0.24% to 1.74% of wages, depending on the level of risk and protection.

* Jamsostek for construction workers | data

Target: construction workers In 2010, 4,3330,383 workers were registered in this programme.
Benefits: Based on MoMT decree No. 196/1999, all contractors and subcontractors providing construction services must underwrite all their workers into the Jamsostek special insurance for construction workers. This programme provides occupational injury and death insurance for the period of their work contract. In 2010, 4,330,383 workers were registered in this programme nationwide.

* Jamsostek pilot programme for informal economy workers | data

Target: informal sector workers.
Benefits: the Jamsostek pilot programme, piloted since 2006, includes occupational injury benefits. The contribution for the occupational injury benefit is set at 1% of income, where "income" is set at the minimum wage level of IDR 1 million per month.  It covers approximately 400,000 informal sector workers (as of 2011).

Target: informal sector workers.
Benefits: under the Askesos programme for informal sector workers, members receive IDR 300,000 (maximum one claim per person per benefit per year) in case of employment injury. The scheme was modified in 2012 (on a pilot basis) to provide lump sum and periodic payments in case of employment injury and disability due to work related accidents. The new pilot scheme is administered by Jamsostek.

 

Death benefit

*Jamsostek death benefit for formal sector workers (JK)

Target: formal sector workers.
Benefit: based on Government Regulation No. 14/1993, in case of death during active employment (whatever the cause), the dependents of the deceased employee are provided benefits which include a lump sum of IDR 10 million, a funeral grant of IDR 2 million, and monthly transfers of IDR 200,000 per month for 24 months. The contribution to the death grant is made only by the employer, amounting to 0.3% of wages.

Target: informal sector workers.
Benefits: the death benefits amounts IDR 400,000 if the member dies in the first year of the membership, IDR 600,000 if death occurs in the second year of membership, or IDR 800,000 if death occurs in the third year of membership. The scheme was modified in 2012 (on a pilot basis) to provide lump sum and periodic payments in case of death of the insured. The new pilot scheme is administered by Jamsostek.

*Jamsostek pilot programme for informal economy workers | data

Target: informal economy workers earning at least the minimum wage (approximately IDR 1 million per month, but subject to variations across provinces).
Benefits: the jamsostek pilot programme for informal economy workers, piloted since 2006, includes death benefits. The contribution for the death benefit is set at 0.3% of the minimum wage.

Regulatory Framework

First law: 1951 (Act No. 2, workmen's compensation).


Current law: 1992 (Act No. 3, employees' social security).

Type of program: Social insurance system.

Coverage

Employees of establishments with 10 or more employees or a monthly payroll of at least 1 million rupiah.

Voluntary coverage for self-employed persons.

Coverage is being extended to employees of smaller establishments and to organized informal-sector workers, including family labor, fishermen, and employees of rural cooperatives.

Special system for public-sector employees.

Source of funds

Insured person: None.

Self-employed person: 1% of monthly declared earnings.

Employer: The total cost; contributions vary according to five classes of risk: 0.24% of monthly payroll (class I); 0.54% (class II); 0.89% (class III); 1.27% (class IV); or 1.74% (class V).

Government: None.

Qualifying conditions

Work injury benefits: Must be assessed with a partial or total disability before age 55. There is no minimum qualifying period.

Cash benefits for insured workers (except permanent disability)

Temporary disability benefit: The monthly benefit is 100% of the insured's wage in the month before the disability began and is paid for the first 4 months; 75% for the next 4 months; 50% thereafter until rehabilitation or the determination of permanent disability.

The degree of disability is assessed by Jamsostek, based on a health examination by a medical doctor.

Permanent disability benefits for insured workers

Permanent disability benefit: A lump sum is paid of 70% of 80 months of the insured's wage in the month before the disability began, plus a monthly benefit of 200,000 rupiah for 24 months.

Partial disability: A lump sum is paid of 80 months of the insured's wage in the month before the disability began multiplied by the assessed degree of disability according to a schedule in law.

The degree of disability is assessed by Jamsostek, based on an examination by a medical doctor.

Medical benefits for insured workers

Medical benefits: Medical benefits include medical treatment, hospital care, dental and eye care, and prostheses.

The maximum cost of medical treatment and hospital expenses is 12,000,000 rupiah per accident.

Transportation costs from the place of the accident to the hospital are provided up to 1,500,000 rupiah depending on the method of transport used.

Survivors benefits for dependents

Survivor benefit: A lump sum is paid of 60% of 80 months of the deceased's wage in the month before death, plus a monthly benefit of 200,000 rupiah for 24 months.

Eligible survivors (in order of priority) are the spouse, children, parents, grandchildren, grandparents, siblings, and parents-in-law. In the absence of eligible survivors, the benefits are paid to a person named by the deceased; in the absence of a named survivor, only the funeral grant is paid to the person who pays for the funeral.

Funeral grant: A death grant of 10 million rupiah and a funeral grant of 2 million rupiah are paid to the survivor eligible for the survivor benefit; in the absence of an eligible survivor, the funeral grant is paid to the person who pays for the funeral.
