The extension of work injury protection to migrant workers was approved

Outcome achieved

The full implementation of the extension of work injury protection to migrant workers under the Employees ‘social security was achieved following the Employees’ Social Security (exemption of foreign (revocation) Notification 2018.

ILO's contribution to the outcome

ILO has provided technical advice since 2015 on the issues of Equality of Treatment, extension of coverage and the legal amendments to the law. Support included meeting and workshops to present the principles of the Equality of Treatment (Accident Compensation) Convention, 1925 (No. 19) and to discuss its implementation and the way forward (15-16 December 2015), and on 8 June 2017 a meeting with H.E Minister of Human Resources. A Direct Contact Mission visited Malaysia in October 2019 and presented to the Committee of Experts on the Application of Conventions and Recommendations and to the committee on the Application of Standards (CEACR). In 2020 the findings on the application of C019 - Equality of Treatment (Accident Compensation) Convention, 1925 (No. 19). The CEACR noted: “The Committee notes with satisfaction the information provided by the Government that foreign workers are now covered under the Employees’ Social Security Act.”
